Privacy Policy Statement for China Unicom International Limit

1.Preamble
1.1 This Privacy Policy Statement sets out the obligations and policies of China Unicom International Ltd., (“Unicom”) in relation to the use of personal data held by Unicom. It explains the key measures we take to implement the requirements of the Hong Kong SAR Personal Data (Privacy) Ordinance 1995 – Cap. 486 (“PDPO”).
1.2 Unicom’s operations are subject to privacy legislation other than that of Hong Kong SAR (“HKSAR”) and this policy shall apply to the extent practicable and consistent with such local legislation.
1.3 The meaning of “personal data” in this policy was defined in the PDPO.

2.Provision of services
2.1 Unicom shall fully comply with the obligations and requirements of the PDPO. Unicom’s officers, management, and members of staff shall, at all times, respect the confidentiality of and endeavor to keep safe any and all personal data collected and/or stored and/or transmitted and/or used for, or on behalf of, Unicom.
2.2 Where an individual legitimately requests for access to and/or correction of personal data held by Unicom relating to the individual, Unicom shall provide and/or correct the data in accordance with the times and manner stipulated under the PDPO.

3.Collection Of Peresonally Identifiable Information And Use
3.1 Unicom will collect  personal data of our customers for the following purposes
 
  • For the provision of Unicom’s services and facilities to our customers ;
 
  • For carrying out  instructions or responding to  inquiry of our customers;
 
  • For account management, telephony services, credit, financial or any other related services, whether those services are implemented by Unicom or by a third party;
 
  • For assessing credit worthiness of our customers;
 
  • For determining the amount of indebtedness owed to or by our customers ;
 
  • For credit management including collection of amount outstanding from  our customers;
 
  • For designing further products and services for our customers and marketing Unicom’s products or services;
 
  • For forming part of customer database necessary for the operation carried on by Unicom;
 
  • For observing any legal, governmental or regulatory requirements of Hong Kong or other relevant jurisdiction including any disclosure or notification requirements to which Unicom, are subject; and/or
 
  • For any purposes related to and/or for the furtherance of any of the above.
3.2 The personal data collected by Unicom include the following
 
  • Name;
 
  • Gender;
 
  • Identity Card No./Passport No. and copy;
 
  • Occupation/Profession;
 
  • Address;
 
  • Telephone and fax numbers;
 
  • Data relating to calls and billing;
 
  • E-mail address; and/or
 
  • Other data necessary for Unicom to provide services and/or products to our customers..
3.3 All personal data will be collected on a voluntary, open and fair basis. Whilst you are entitled to refuse to provide any of the aforesaid personal data, incomplete disclosure may prevent Unicom from rendering service to you as a valued customer of Unicom.

4.Accuracy
4.1 Unicom will take all practicable steps to ensure that the personal data so collected are accurate. However, we request for  cooperation from our customers in providing accurate personal data upon subscription and thereafter updating Unicom of any change of personal data are always welcome.

5.Security
5.1 All personal data are stored in a secure place and/or system to the extent that any unauthorized access is strictly prohibited.

6.Access And Correction
  Our customers have the right to :
6.1 know whether Unicom holds any of  their personal data and access to such data;
6.2 require Unicom to correct any inaccurate personal data relating to them; and
6.3 ascertain the privacy policy and practices in relation to personal data and the kind of personal data held by Unicom.
  In accordance with PDPO, Unicom may charge a reasonable fee for processing any data access request.

7.Retention Of The Information
  Unicom will destroy any personal data it may hold in accordance with its internal retention policy. The policy states that:
7.1 personal data will only be retained for as long as is necessary to fulfil the original or directly related purpose for which it was collected, unless the personal data is also retained to satisfy any applicable statutory or contractual obligations; and
7.2 personal data are purged from Unicom’s electronic, manual, and other filing systems in accordance with specific schedules based on the above criteria and Unicom’s internal procedures.

8.Disclosure Of Personal Data
  All personal data held by Unicom will be kept confidential but Unicom may, where such disclosure is necessary to satisfy the purpose, or a directly related purpose, for which the data was collected provide such information to the following parties:
8.1 any subsidiaries, holding companies, associated companies, or affiliates, or companies controlled by, or under common control with Unicom;
8.2 any person or company who is acting for or on behalf of Unicom, or jointly with Unicom, in respect of the purpose or a directly related purpose for which the data was provided;
8.3 any other person or company who is under a duty of confidentiality of Unicom and has undertaken to keep such information confidential, provided such person or company has a legitimate right to such information; and
8.4 any financial institutions, charge or credit card issuing companies, credit information or reference bureaus, or collection agencies necessary to establish and support the payment of any services being requested.
  Personal data may also be disclosed to any person or persons that have a right under the PDPO to gain access to such information provided they are able to prove their authority to access such information. For example, if Unicom were served with a court order demanding certain customer information then Unicom would disclose the information to the duly appointed officer of the court or such other persons as the court orders.

9.Direct Marketing
9.1 In accordance with the requirements of the PDPO, Unicom will honor an individual’s request not to use his or her personal data for the purposes of direct marketing. Should our customers wish not to receive direct marketing material from Unicom, please write to Unicom Privacy Compliance Officer at the address listed below.
9.2 Any such request should clearly state details of the personal data in respect of which the request is being made. Specifically, we request that our customers include the corresponding Company assigned account numbers which are printed on Unicom’s statements/invoices. Our customers need  state clearly the authority under which they are authorized to make such a request.
9.3 Unless otherwise instructed as per the above, Unicom may use any of the data collected in the normal course of its business for marketing purposes.
